我們生活在“意識形態化”的現代社會中，是不能在古漢語的意義上來使用“制度”一詞的。因此，盡管古漢語中“制度”的原義近同于英文中的institution，我們卻不能以此作為把英文的institution翻譯為中文的“制度”的根據。

以上我們只是考究了英文institution一詞的一重含義。除了這一基本含義外，這個英文詞還有其他多重含義。這個詞另一個常見的含義就是組織機構。譬如，一所大學、一個研究所、一家醫院、一個教會，甚至一個國家機關和市政委員會均可以被稱為一個institution。從這種含義上來說，institution是指一種有形有體、有建筑物和設備，并有人在其中活動且這些人遵守著某些活動規則和行動程序的組織機構。0.5

除了我們上面所考究的兩重含義外（許多經濟學家如美國經濟學家康芒斯（Commons，1934）就區分不開上述這兩種含義的institution），institution在英語國家的使用中還有其他多種多樣的含義。例如，如果一家企業在金融市場上上市，而另一家銀行、財團或信托公司購買了這家企業的股票，那么，這一銀行、財團或信托公司就被稱為 institutional investor，即“法人投資者”。這里，institution顯然就是意指“法人”。除此之外，institution在英文中還被常常用來指某個人或某些人的職位。譬如，在克林頓（Clinton）的性丑聞被炒得沸沸揚揚期間，美國媒體就經常使用“the institution of presidency”一詞。這里的institution顯然就是指總統職位。另外，據美國經濟學家Daniel

在對英文的institution一詞作了上述繁復的語義考察之后，我們似乎又應該回到維特根斯坦的語言哲學那里去了。略有些當代西方哲學知識的人都會知道，在維特根斯坦的晚期哲學階段，他徹底推翻了自己早期邏輯哲學中的精美的奧古斯丁（Augustine）式的圖式論（即語言中每一個詞（概念）都標示著現實中的一種對象（性），因而二者有著—一對應關系），從而把語言視作為一種“游戲”（即gain）。維特根斯坦（Wittgenstein，1967，§ 43）有一句名言：“一個詞的意義就是它在語言中的用法。”把維特根斯坦的這句話說白了就是，與其我們繁復迂回地去考究一個詞（概念）的含義，還不如去看人民大眾在日常生活中是如何使用這個詞的。具體到institution這個英文詞本身來說，我們與其去苦思冥想地領悟和揣度諾貝爾經濟學獎得主級的經濟學家們是如何界定這個詞的，還不如去看講英語的國家里的人民大眾是如何使用這個詞的。0.6談到這里，使我們想到 Shorter Oxford English Dictionary（在英文中相當于中文的小《新華字典》）對institution這個詞的界說：“an established law，custom，usage，practice，organization”（從上面的論述中我們可以知道，這個定義實際上取之多卷本《牛津大辭典》中的一意）。這個解釋最簡單，卻一下子道 出了這個英文詞的最基本含義。如果我們把這一定義拆解開來，并從后面的構成詞往前看，也許更能體悟出這一“大眾使用法”之界說的精妙。在這一界說中，“an established organization”很顯然是指上面所說的institution的第二種含義，即組織機構的意思。依次往前，我們可以把它理解為一種行事方式（practice）、一種習慣（usage——請注意這里不是指英文中作為一種人們行事的心理定勢的“習慣”，即habit）、一種習俗（custom）、一種法律（law）即“（小）制度”。然而，這里的問題是，即使單從這一“大眾使用法”來看，用中文的“制度”一詞來對譯institution也是不合適的。因為，如果說，中文的“制度”能涵蓋英文institution一詞法律層面的含義的話，它卻囊括不了其practice usage和custom等含義。因為，人們社會活動與交往中的種種行事方式、習慣和習俗等只是一種事態、一種情形，或者按哈耶克的術語來說是一種“自發社會秩序”，但并不是一種業已確立、建立或制定出來的“辦事規程和行動準則”（即中文的狹義的“制度”）。但是，如果我們現在使用“制序”這個詞，就可以較好地涵蓋英文institution一詞的多種含義。“制序”一詞中的“制”，我們可以把它理解為“建制”、“制度”和“規制”等多重含義，而其中的“序”又可以理解為“秩序”，從而把英文institution一詞中所包含的practice, usage, custom,買粉絲nvention等多重含義囊括其中。這是筆者主張用“制序”一詞來對譯英文institution一詞的主要理由。因為，用“制序”來對譯英文的institution，一方面可以使我們避免常常發生的它與現代中文意識形態化的“社會制度”一詞中的“大制度”（regime）“剪不斷，理還亂”式的混淆，另一方面又能較好地涵蓋英文institution一詞多重且寬泛的含義。
