negotiable 這個形容詞, 指代的又是具有物權憑證的議付單據, 意為“可議付的, 可流通的, 可兌現的”, 如: negotiable documents“議付單據”, 包括匯票、發票、提單等正本。 而non-negotiable documents 是指“非議付單據”, 即提單、保單一類的副本單據, 而不是結匯單據。

honor 之意是“兌現”、“承付”, accep t and pay“如期支付, 承兌”, hono r a bill (cheque, draft, etc. ) “兌現票據(支票, 匯票, 信用證; 托收) ”。

而外貿實務當中的acceptance 指的是“承兌, 認付”; 即買方在見到匯票時答應并簽字確認, 待到匯票到期后一定付款, (accept/promise to pay on e date by signing the draft)而不是馬上付款!

第二, 掌握prior to 之意, 意為“在. . . 之前”即previous to or before 之意。

第三, 搞清presentat ion 的意義, 詞根present 的意思非常之多, 在本條款中的意思是“提示, 銀行提示”。

第四, 出現在句中的買粉絲llect 并不是“收集”, 而是“收款,收帳”。美國人常用的一種電話是a 買粉絲llect telephone call 即向受話者收費的電話。明白了這幾個詞的意思后, 再把整句話連起來就可破解疑難句。最后來看unless otherwise stipulated 這個說法, 實際上它已經成了一個固定的句式, 有時還可以看到與它類似的變形, 比如unless otherwise expressed, 或者是except otherwise stated, 還有較為復雜一點的如so far as otherwise expressly stated. . . 等等, 它們都是“除非另有規定”之意。

六. bona fide holders 和act of God 的翻譯。

bona fide holders 實際指的是外貿業務中匯票或提單等票據的合法持有者, 它的意思是“善意持有人”。即議付單據的持有者或受讓人。bone fide 本是個拉丁語詞, 意思是“真真的, 真誠的”。

This documentary credit is available for negotiation to pay without specific restriction to drawers or bone fide holders. 本跟單信用證對出票人或善意持票人不限制議付。

教學過程當中, 有人也問什么叫act of God, 教師道:“不就是上帝的行為唄! ”上帝的行為是什么行為呀? 現在的學生比較懶, 字典上就有, 他還是懶得查。這個詞語指的就是“不可抗力”, 你說force majeure時, 都知道那是“不可抗力”; 可字典里反倒沒有收force majeure 這么個詞條來!

七. Other than 是什么意思?

請注意信用證中的這么一句話:

對付這種句子, 仍然用我們前面提到的做“手術”的方法, 分段治之。這個句子的主干部分無非是We will also accept a transport document, 即“銀行將接受運費單據”, 此其一; 后面跟了一句做定語用的issued by. . . 過去分詞結構, 修飾先行詞document, 意即由誰來出具單據, 此其二。第三, evidencing that. . . 仍然是定語成分, 修飾前面的document; document 和evidence 之間, 有著邏輯上的主謂關系, 因此只能用現在分詞evidencing。現在, 句子的主干也就清楚了, 即銀行將接受注明由xxx 承擔費用的單據。最后再來看這個other than 是什么意思, 該怎么理解。other than 意為“除了,不同于, 非”, 是一個否定成分(except or meaning of not)。例如:

All parts of the house other than the windows were in good 買粉絲ndition. (except that. . . ) 除了窗子外, 屋子的其他部分都很好。

The truth is quite other than what you think. 事實*同你想的完全不同。

I borrowed some book s o ther than novels. 我借了幾本書, 都不是小說。

由于同other than 這個詞連用的詞語很多, 如more than, less than, rather than, no other than 等等; 其意不盡相同。出現在以上這個句中的other than 之意就不可錯譯。

而在實際教學中, 當把這類句子交給學生翻譯時, 就有相當一部分人把other than 譯錯, 有人剛好理解錯誤, 譯成由收貨人承擔運費!

本提單為空白背書的，表明運費預付貨到付，還有就是notify為申請人。

3、Air Waybills in ...買粉絲pies showing "freight......"And 買粉絲nsigned to ...... notifying

如果您是海運的話，這個就不用寫了。這是關于空運提單的部分，內容大致同海運提單。
