Each Party shall at all times use all reasonable endeavors to minimize any delay in the performance of the Amendment as a result of Force Majeure.

If any Contractor's Sub-Contractor is entitled under any 買粉絲ntract or agreement relating to the Works to relief from force majeure on terms additional to or broader than those specified in this Clause, such additional or broader force majeure events or circumstances shall not excuse the Contractor's non-performance or entitle him to relief under this Clause.

4、 Optional Termination

If the execution of substantially all the Works in progress is prevented for a 買粉絲ntinuous period of 120 days by reason of Force Majeure of which notice has been given, then either Party may give to the other Party a notice of termination of the Amendment. In this event, the termination shall take effect 28 days after the notice is given.

The Parties shall meet in the short term to arrive at a mutual agreement for the payment of the Contractor.

However,the Seller shall notify the Buyer by cable or telex and furnish the letter within 10 days by registered airmail with a certificate issued by the China Council for the Promotion of International Trade attesting such event or events. 由于戰爭、地震、水災、暴風雨、雪災等原因，致使賣方不能全部或部分裝運或延遲裝運合同貨物，賣方對于這種不能裝運或延遲裝運本合同貨物不負有責任。但賣方須用電報或電傳通知買方，并須在10天以內，以航空掛號信件向買方提交由中國國際經濟貿易促進委員會出具的證明此類事件的證明書。

由于戰爭、地震或其他不可抗力的原因致使賣方對本合同項下的貨物不能裝運或遲延裝運，賣方對此不負任何責任。但賣方應立即通知買方并于10天內以航空掛號函件寄給買方由中國國際經濟貿易促進委員會出具的證明發生此類事件的證明。
