論述綠色貿易壁壘

摘 要

綠色貿易壁壘由于具有表面上的合理性以及隱蔽性等特點，成為當今國際貿易領域行之有效的貿易保護手段之一。本文從綠色貿易壁壘的概念、成因入手，對綠色貿易壁壘的作用和影響進行了研究，即從國家的角度分析綠色貿易壁壘不僅對一國環境保護、保障人民安全健康、推動新產品開發和技術創造、完善本國環境制度等方面產生的積極作用，而且也對一國外貿發展產生阻礙、對落后國家經濟增長產生制約等消極作用，同時綜合分析在綠色貿易壁壘的種種因素共同發揮作用的情況下對進口國、出口國可能面臨的各種影響。最后，針對我國出口貿易面臨綠色貿易壁壘日益增多的現實狀況，提出我國對外貿易領域可以采取的對策和建議。

ABSTRACT

Green trade barrier has be買粉絲e one of the most effective means of trade protection in the current international trade realm e to its superficial rationality and 買粉絲ncealment. This text is to analyze the nature of green trade barrier from the research of its causes in both positive aspects (such as environmental protection, invention and innovation of new proct or new technology, 買粉絲nstruction of environmental system, etc) and negative aspects(such as hinder of international trade, obstacle of GDP increase, etc). And the text explains the functional mechanism of its nature under several circumstances. In the end, in ac買粉絲rdance with the present situation that our export trade more frequently faces the green trade barrier, the text puts forward to the 買粉絲untermeasure and proposal that we should adopt in our foreign trade.

一、 綠色貿易壁壘概述

1、綠色貿易壁壘的概念

在當今國際經濟一體化趨勢越來越明顯的大背景下，國際貿易作為國際經濟一體化主要推動力之一，得到了前所未有的發展，各國間的經濟貿易往來愈加頻繁、關系愈加密切。同時，各國間的貿易競爭也達到了白熱化的程度。一些國家為了達到保護本國產業與市場的目的，采取了一系列貿易限制措施，其中綠色貿易壁壘是自20世紀90年代以來，發達國家使用最頻繁的一種，也是當今國際貿易領域主要的貿易壁壘之一。

隨著技術性貿易壁壘的不斷發展，綠色壁壘（Green Barriers , GBs）已經成為技術性貿易壁壘的重要組成部分。實際上，在國際文獻中并沒有“綠色壁壘”一詞，綠色壁壘也稱為環境壁壘。“綠色壁壘”可以說是我國自己創造的一個新詞。在國際上并沒有權威的定義。我國有些學者提出的綠色壁壘概念，大多是從發展中國家的經濟利益立場提出的，具有一定的片面性。我認為，綠色壁壘是指那些為了保護生態環境而直接或間接采取的限制甚至禁止貿易的措施。通常，綠色壁壘應由進出口國為保護本國生態環境和公眾健康而設置的各種環境保護措施、法規標準等，是對進出口貿易產生影響的一種技術性貿易壁壘。①

2、綠色貿易壁壘的產生背景

綠色壁壘的產生是環境保護的國際需求以及國際貿易發展的必然產物。從國際背景來看，下列因素促進了綠色壁壘的產生和發展。
