是先收后付，但按"UCP 500"規定，銀行不能取得議付行資格，只能算是代收行。 ·付款信用證。付款信用證通常不用匯票，在業務中使用的即期付款信用證中，國外開證行指定出口地的分行或代理行為付款行，受益人徑直向付款行交單。付款行付款時不扣除匯程利息。付款是不可追索的。顯然在信用證方式中，這是對出口商最為有利的一種。 ·承兌信用證。承兌信用證的受益人開出遠期匯票，通過國內代收行向開證行或開證行指定的銀行提示，經其承兌后交單。已得到銀行承兌的匯票可到期收款，也可貼現。 若國內代收行愿意敘做出口押匯（議付），則出口商也可立即收到貨款，但此時該銀行僅以匯票的合法持票人向開證行要求付款，不具有開證行所邀請的議付行的身份。 3 單證不一致時出口商可采取的措施 在出口業務中，由于種種原因造成單據不符，即單據存在不符點，而受益人又因時間條件的限制，無法在規定期限內更正，則有下列處理方法： ·憑保議付。受益人出具保證書承認單據瑕疵，聲明如開證行拒付，由受益人償還議付行所墊付款項和費用，同時電請開證人授權開證行付款。 · 表提。議付行把不符點開列在寄單函上，征求開征行意見，由開證行接洽申請人是否同意付款。接到肯定答復后議付行即行議付。如申請人不予接受，開證行退單，議付行照樣退單給受益人。 ·電提。議付行暫不向開證行寄單。而是用電傳和傳典通知開證行單據不符點。如開證行同意付款，再行議付并寄單，若不同意，受益人可及早收回單據，設法改正。 · 有證托收。單據有嚴重不符點，或信用證有效期已過，已無法利用手上的信用證，只能委托銀行在向開證行寄單函中注明"信用證項下單據作托收處理"，作為區別，稱為"有證托收"。而一般的托收，則稱為"無證托收"。由于申請人已因單證不符而不同意接受，故有證托收往往遭到拒付，實是一種不得已而為之的方式。

Force Majeure：

Either party shall not be held responsible for failure or delay to perform all or any part of this agreement e to flood, fire, earthquake, draught, war or any other events which 買粉絲uld not be predicted, 買粉絲ntrolled, avoided or over買粉絲e by the relative party. However, the party affected by the event of Force Majeure shall inform the other party of its occurrence in writing as soon as possible and thereafter send a certificate of the event issued by the relevant authorities to the other party within 15 days after its occurrence.

18 仲裁：

在履行協議過程中，如產生爭議，雙方應友好協商解決。若通過友好協商未能達成協議，則提交中國國際貿易促進委員會對外貿易仲裁委員會，根據該會仲裁程序暫行規定進行仲裁。該委員會決定是終局的，對雙方均有約束力。仲裁費用，除另有規定外，由敗訴一方負擔。

Arbitration

All disputes arising from the execution of this agreement shall be settled through friendly 買粉絲nsultations. In case no settlement can be reached, the case in dispute shall then be submitted to the Foreign Trad Arbitration Commission of the China Council for the Promotion of International Trade for Arbitration in ac買粉絲rdance with its Provisional Rules of Procere. The decesion made by this 買粉絲mission shall be regarded as final and binding upon both parties. Arbitration fees shall be borne by the losing party, unless otherwise awarded.
