外貿企業的介紹

外貿企業是指企業有從事對外貿易（進出口）的企業，在國家規定的注冊企業的相關領域內，這些企業對合法產品有進出口經營權。出口方面，2008年下半年中國外貿形勢不好，國家在10月和11月兩個月內已兩次調高出口退稅率來刺激外貿企業出口。

企業商品，產品和服務流通到兩個或兩個以上的國家或地區的企業經濟組織．它可以是自己生產的，也可以是通過收購別人的產品來實現．為了保護本國經濟發展或民族工業，一般的國家都會制定一系列的政策法律加以鼓勵或約束外貿行為，一個企業要從事外貿業務，就必須得到相關國家的行政許可，即取得進口出口權，否則就是非法交易。

從事外貿的企業審批往往比較復雜，要通過海關、商檢、銀行、保險、商會、政府主管部門來實現，同時企業的從事的活動還要符合WTO的相關規定和國際慣例。 根據國家稅務總局關于進一步規范出口退（免）稅申報、審核程序的通知，出口企業在辦理出口退稅時要特別注意申報程序，注意時間觀念，以免造成損失。出口企業在辦理出口退稅時，應注意四個時限規定：

一、“30天”

外貿企業購進出口貨物后，應及時向供貨企業索取增值稅專用發票或普通發票，屬于防偽稅稅控增值稅發票，必須在開票之日起30天內辦理認證手續。

二、取消“90天”

自2012年7月1日起，外貿企業必須在貨物報關出口之日（以出口貨物報關單〈出口退稅專用〉上的出口日期為準）次月起至次年4月30日前辦理出口退稅申報手續，生產企業必須在貨物報關出口之日（以出口貨物報關單〈出口退稅專用〉上的出口日期為準）次月起至次年4月30日前免抵退稅申報期內辦理免抵稅單證收齊申報手續。

三、“180天”

出口企業必須在貨物報關出口之日起180天內，向所在地主管退稅部門提供出口收匯核銷單（遠期收匯除外）。

四、“3個月”

若出口企業出口貨物紙質退稅憑證丟失或內容填寫有誤，按有關規定可以補辦或更改的，出口企業可在申報期限內向退稅部門提出延期辦理出口貨物退（免）稅申報的申請，經批準后，可延期3個月申報。 根據《關于財政性資金、行政事業性收費、政府性基金有關企業所得稅政策問題的通知》（財稅〔2008〕151號）第（二）款規定，對企業取得的由國務院財政、稅務主管部門規定專項用途并經國務院批準的財政性資金，準予作為不征稅收入，在計算應納稅所得額時從收入總額中減除。本條所稱財政性資金，是指企業取得的來源于政府及其有關部門的財政補助、補貼、貸款貼息，以及其他各類財政專項資金，包括直接減免的增值稅和即征即退、先征后退、先征后返的各種稅收，但不包括企業按規定取得的出口退稅款。

因此，外貿商業企業收到的出口退稅款不繳企業所得稅。
